1. Identity and Address of the Data Controller
TMC Global VC, S. de R.L. de C.V., operating commercially under the brands Tijuana Medical Corp, Lipo Tijuana VIP, and Men’s Clinic Tijuana (“the Clinic”), with Federal Taxpayer ID (RFC) TGV180221CC0, and domicile at Av. Dr. Atl #1, Suite 202, Tepeyac Building, Zona Urbana Río Tijuana, C.P. 22010, Tijuana, Baja California, Mexico, is responsible for the processing of your personal data, in compliance with the Federal Law on Protection of Personal Data Held by Private Parties in effect since March 21, 2025 (“the Law”), and makes this Privacy Notice available to you under Article 14 of the Law.
2. Personal Data We Collect
In accordance with Article 15 of the Law, for the purposes described in this Notice, we may collect the following categories of personal data:
- Identification and contact data: full name, date of birth, address, phone number, email, passport or official ID.
- Emergency contact information.
- Financial and billing data: payment information necessary to process charges for services.
- Sensitive personal data related to health: medical history, allergies, medications, pre-existing conditions, lab or clinical study results, and clinical and follow-up photographs taken before, during, and after treatments.
- Where applicable, biometric data associated with the electronic signature used to sign consent forms and clinical documents.
Because this involves sensitive personal data related to your health, such data requires your express, written consent, which is collected through the corresponding informed consent forms (Medical History, Photograph Consent, among others).
3. Purposes of Processing
In accordance with Article 15 of the Law, we distinguish below the purposes that do not require your consent (primary) from those that do (secondary):
Primary purposes (necessary for our relationship with you):
- Providing the requested medical, aesthetic, and wellness services.
- Creating, updating, and maintaining your clinical record.
- Scheduling appointments and following up on your treatment.
- Processing payments and issuing invoices.
- Coordinating medical tourism logistics where applicable (transportation, lodging, transfers).
- Communicating with you via WhatsApp, SMS, phone, or email regarding your treatment.
Secondary purposes (not necessary; you may opt out without affecting the medical care you receive):
- Use of photographs for promotional, advertising, or marketing purposes on social media and digital platforms, always subject to your express and separate consent.
- Sending promotions, satisfaction surveys, and newsletters.
4. Transfer of Personal Data
Under Article 35 of the Law, your personal data may be transferred to: clinical laboratories and healthcare providers for tests and studies; payment processing platforms (e.g., Stripe) to manage charges; customer relationship management and communication providers (e.g., GoHighLevel, based in the United States), under confidentiality agreements; and social media platforms (Instagram, Facebook, TikTok) only when you have granted express consent for promotional purposes, understanding that such platforms have their own privacy policies and may store information outside of Mexico. We do not sell or trade your personal data to unauthorized third parties.
5. Mechanisms to Limit the Use or Disclosure
You may request not to receive promotional communications, or decline to consent to the use of your photographs for marketing purposes, without this affecting the quality of the medical care you receive.
6. ARCO Rights and Withdrawal of Consent
Under Article 22 of the Law, you have the right to Access, Rectify, Cancel, or Object (“ARCO Rights”) to the processing of your personal data, and to withdraw your consent at any time, by submitting a written request to: tijuanamedicalcorp@gmail.com, stating: (i) your full name, (ii) proof of identity, (iii) a clear description of the right you wish to exercise, and (iv) any document that helps locate your data. Under Article 31 of the Law, we will communicate our determination within a maximum of 20 business days, and if applicable, make it effective within the following 15 business days. Exercising your ARCO Rights is free of charge under Article 34 of the Law, except for applicable reproduction or delivery costs. This right is subject to the exceptions set forth in Article 25 of the Law. Withdrawal of consent will not have retroactive effect on processing already carried out.
7. Data Retention Period
Under Article 17 of the Law, retention periods for your personal data shall not exceed what is necessary to fulfill the purposes for which they were processed. Accordingly, personal data related to your clinical record will be retained for a minimum period of 5 Years, in accordance with applicable health regulations. Data used exclusively for marketing purposes will be retained until you withdraw your consent or request its cancellation.
8. Use of Tracking Technologies
If you use our websites (www.lipotijuanavip.com, medicalcorptijuana.com), we may use cookies or similar technologies to improve your browsing experience. You may disable them through your browser settings.
Our contact page includes an interactive Google Maps map showing the Clinic’s location. Loading this map may allow Google to set its own cookies and collect browsing data under its own privacy policy, which is separate from ours.
9. Changes to this Privacy Notice
Any changes to this Privacy Notice will be published on our websites and/or communicated through the contact information we have on file.
10. Competent Authority
If you believe your right to personal data protection has been violated, you may file a complaint with the Secretaría Anticorrupción y Buen Gobierno, the competent authority under the Federal Law on Protection of Personal Data Held by Private Parties in effect since March 21, 2025.
11. Consent
By providing us with your personal data and/or signing the corresponding informed consent forms, you acknowledge that you have read, understood, and accepted the terms of this Privacy Notice.
